◤知多点◢ 遭雇主无理解雇 可向人力资源部投诉
问:当员工认为他或她在没有被给予正当或公正的理由 (without just cause or excuse) 的情况下被解雇,请问可以如何投诉?
答:如果员工觉得本身被无理解雇,根据1967年工业关系法令第20(1)条文,员工有权利以书面的方式,在被解雇的60天以内,向工业协调局投诉,要求复职。

员工能够透过以下管道向人力资源部属下的工业协调局询问更多详情/提出投诉:
(a) 亲自上门或致函至离工作地点最靠近的工业协调局(http://jpp.mohr.gov.my/profail/cawangan);
(b) 电邮至总行: [email protected]
(c) 拨电至总行:03-8886 5460
投诉者所需要呈交的资料如下:
(1) 完整的投诉表格 (表格下载: http://jpp.mohr.gov.my/…/borang%20representasi%20baru%2011j…);
(2) 相关文件,比如:录取信件 (offer letter), 雇佣合约 (employment contract),解雇信件 (letter of termination) 等。
根据工业协调局的客户章程,一旦接获投诉,相关投诉必须在接获投诉之日起的14天内被调查以及被作出回应。

Section 20 Industrial Relations Act – Representations on dismissals
(1) Where a workman … considers that he has been dismissed without just cause or excuse by his employer, he may make representations in writing to the Director General to be reinstated in his former employment; the representations may be filed at the office of the Director General nearest to the place of employment from which the workman was dismissed.
